% 27.02.2017 The learned counsel submits having regard to the rate of rent of the demised premises payable by the defendant and in view of the provisions contained in Section 7 (xi) of the Court Fees Act, 1870 read with Section 8 of Suit Valuation Act, 1887, this case will have to be instituted before the district court and has been wrongly instituted in this Court. Thus, on the oral prayer, the plaint is directed to be returned to be presented again before the court of appropriate jurisdiction.
