Petitioner seeks anticipatory bail in FIR No.83/2019 under Sections 376D/506/34 IPC, Police Station Sangam Vihar. 2.

Allegations in the FIR are that the prosecutrix was known to the co-accused Vishal Mohd. and he asked her to accompany him for the purposes of securing a job for her. Thereafter he took her to a flat in Sangam Vihar where the petitioner was alleged to be present. The coaccused is alleged to have told the petitioner to get tea for her. When the petitioner left, it is alleged that the co-accused raped her. Subsequently, when the petitioner came back, the co-accused left and the petitioner also raped her.

By order dated 14.06.2019, interim protection was granted to the petitioner subject to joining investigation. 4.

Learned APP for the State, under instructions from the Investigating Officer, submits that the petitioner did join investigation and during investigation certain material has come on record, on account of which, chargesheet is being filed without arrest insofar as the petitioner is concerned.

In view of the above statement, learned counsel for the petitioner seeks leave to withdraw the petition. 6.

Petition is, accordingly, dismissed as withdrawn. 7.
