O R D E R

% 14.10.2019 CRL.M.A. 12572/2019 As per the CDR details, as stated by W/SI Kamlesh Meena, the phone location of the petitioner from 21.01.2019 to 26.01.2019 was of Muzarffar Nagar and not in Delhi. She further states that in the FIR, name of the petitioner and co-accused Wasim was also mentioned. However, in the statement recorded under Section 164 Cr.P.C., prosecutrix named only the petitioner. Therefore, she has decided to file charge-sheet against the petitioner without arrest of Wasim.

In view of the fact of the CDR details, the IO/ Arresting Officer of the case is hereby directed that in the event of arrest, the petitioner/ applicant be released on bail on the following terms and conditions:-

(i) That the petitioner shall furnish a personal bond in the sum of ₹20,000/- with one surety in the like amount subject to the satisfaction of Arresting Officer/IO concerned;

(ii) That the petitioner shall cooperate with the investigation and make himself available for interrogation by police officer, as and when required; In case of default of aforementioned conditions, the State is at liberty to take appropriate recourse in accordance with law. Before parting with the order, it is relevant to mention that nothing contained in this order shall be construed as an expression on the merits of the case.

Application stands disposed of.
