This petition has been filed assailing the order dated 11th March 2026 passed by the Trial Court in RCA DJ No.3/2026, whereby directions were passed for deposit of 50% of mesne profits in the form of an FDR within a period of one month in relation to an execution pending against the appellant/defendant.

The Trial Court passed an order staying the execution proceedings in Execution No. 192/2025 till the disposal of the appeal. Directions were passed to deposit an FDR of Rs.50,000/- within a week and the balance of 50% of mesne profits (amounting to Rs. 1,15,000/-) within 1 month. 3.

It is submitted by Ms. Divya Singhvi, counsel appearing on behalf of the appellant, that the petitioner earns only a meagre salary, has no immovable property, savings, or other financial assets. He, therefore, prayed that the impugned order be set aside subject to a deposit of only Rs. 50,000/. However, after some arguments, counsel for petitioner, on instructions, submits that instead, the petitioner be granted some additional time to deposit the balance amount.

She further states that an amount of Rs.50,000/- has already been deposited.

It is accordingly directed that the balance amount of Rs.65,000/- be deposited within a period of two months from today. 6.

Accordingly, this petition is disposed of with aforesaid directions. 7.

Pending applications, if any, are rendered infructuous. 8.
