The present petition raises a grievance as regards illegal unauthorized Construction at 83A, Main Market, Amrit Puri Garhi, East of Kailash, New Delhi - 110065.

Learned counsel for the MCD, who appears on advance notice, refutes that any unauthorised construction is ongoing in the property in question. He submits that a sanctioned plan has been issued for the purpose of construction of the property in question.

to the MCD to treat the present petition as a representation which shall be decided by the MCD after affording an opportunity of hearing to the petitioners (as also to the owner/occupier of the property in question) within a period of 4 weeks from today by passing a speaking order. 4.

With the consent of the parties, it is directed that the hearing as aforesaid, shall be afforded by the concerned Executive Engineer on 17.05.2024 at 2.00 PM.

In case the petitioners are aggrieved by the outcome of the aforesaid exercise, they shall be at liberty to take appropriate remedies in accordance with law.
