1. Learned counsel for the petitioner submits that since the respondents have categorically stated in their counter affidavit that the petitioner will be retained in service till he completes qualifying period for pensionable service and will continue to provide him with all necessary medical treatment by retaining him at Delhi itself, he has instructions not to press the petition any further.

2. He further submits that since during the pendency of the present petition, the petitioner has already completed the qualifying service of 10 years, the respondents be directed to expeditiously invalidate him with disability pension for his 100% disability within a time bound manner.

3. Learned counsel for the respondents fairly does not oppose this request.

is disposed of by directing the respondents to take steps in accordance with law within a period of 12 weeks to invalidate the petitioner from service alongwith disability pension for his 100% disability.

5. Needless to state, till orders in this regard are passed by the respondents, the petitioner will be retained in Delhi and rendered all necessary medical assistance.

6. The writ petition is disposed of in the aforesaid terms.
