The present petition has been filed by the petitioners being aggrieved by action of the respondent/MCD in sealing the property of the petitioners bearing Private/Shop No.3, 4346, Gali No.4C, Ansari Road, Daryaganj, Delhi-110002.

The petitioner no.1 is stated to be the owner/occupier of the property in question since 1996. The petitioners being advocates are using the premises in question for the purpose of their lawyers chamber. 3.

action is completely unjustified inasmuch as the property for the purpose of running their chamber, cannot be characterised as misuse. 4.

Although a notice is stated to have been given by the MCD to the petitioner prior to the sealing action, admittedly, the petitioners were not heard prior to the sealing action.

After some hearing, learned counsel for the respondent/MCD submits that the sealing order with regard to the petitioners' premises shall be withdrawn and the property shall be de-sealed forthwith. Further, an appropriate order shall be passed after affording an opportunity of personal hearing to the petitioners.

The aforesaid statement of learned counsel for the MCD is taken on record. Let a hearing be afforded to the petitioners within a period of four weeks from today. Let a reasoned order be passed, within a period of four weeks thereafter.

With the aforesaid directions, the present petition, alongwith pending application/s, stands disposed of.
