The present petition has been filed by the petitioner seeking directions to the respondent to de-seal the premises bearing no. F- 1 (Back Portion), Maharani Bagh, New Delhi - 110065. The said premises were sealed on 27.12.2021.

The premises had earlier been sealed on account of misuse of the concerned property by the unauthorised occupants. Subsequent to legal proceedings initiated by the petitioner, the property in question has been vacated by the unauthorised occupants.

Learned counsel for the petitioner submits that there is no impediment to the property being de-sealed.

Learned counsel for the MCD who appears on advance notice submits that the property in question shall be inspected by the MCD within a period of one week from today and thereafter an appropriate decision as regards desealing of the property will be taken. It is directed accordingly. 5.
With consent of respective counsels, it is directed that the property shall be inspected on 17.05.2024; the petitioner or his authorised representative Mr. Anoop Narang, shall remain present during the inspection and cooperate with the MCD officials. The requisite decision as regards desealing of the property shall be taken within one week thereafter under written intimation to the petitioner.

The present petition stands disposed of in terms of the above directions.

In case the petitioner is aggrieved by the outcome of the aforesaid exercise, he shall be at liberty to avail appropriate remedies in accordance with law.
