% 16.09.2025 CM APPL. 44284/2025 (for early hearing) This is an application for early hearing of the writ petition. With the consent of learned counsel for the parties, the application is allowed, and the writ petition is taken on Board. W.P.(C) 6702/2024 1.

The petition is filed by a federation of retired employees of respondent No. 2 - Food Corporation of India ["FCI"]. They seek a direction that the medical benefits granted to retired employees of FCI be at par with those granted to serving employees. 2.

Mr. Chandra Shekhar, learned counsel for the petitioner, submits that modifications in health benefits to retired employees under the PostRetirement Medical Scheme ["PRMS"] were to be carried out every year W.P.(C) 6702/2024 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. in terms of a circular dated 14.07.2021, but were not, in fact, carried out in each year. He also draws my attention to a circular dated 15.12.2022, which provides for certain revised benefits with effect from 01.04.2023, and states that the next revision of benefits is to take place during the Financial Year 2025-26, which would take effect from 01.04.2026. 3.

Mr. Manoj, learned counsel for FCI, states upon instructions, that a Review Committee has, in fact, been constituted, including a representative of the FCI Workers' Union, which is looking into the revision of benefits under the PRMS.

As the exercise of review is presently underway, no further orders are necessary at this stage in this writ petition. Mr. Shekhar, however, submits that the petitioner be also permitted to participate in the exercise before the Review Committee.

For the present, it is directed that the petitioner may make a representation to the Review Committee for its consideration. If the Review Committee considers it necessary, it may also call the representative of the petitioner for an interaction. If the petitioner remains aggrieved even after the review, it will be at liberty to approach the Court again at that stage.

The writ petition, alongwith pending application, is disposed of with the aforesaid directions.

The next date of hearing, i.e. 27.10.2025, stands cancelled.
