The present petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 read with Section 482 of the CrPC seeks the following prayers:- "(A) Transfer the investigation in relation to FIR No. 629/2024, PS Farsh The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Bazar (investigated by PS Special Cell) to any other specialised wing/unit of the Delhi Police, as the investigation in the aforesaid FIR is being carried out in a motivated, partial, and biased manner by certain officials of the Special Cell to victimise the Petitioner. (B) Pass any further order(s) or direction(s) as this Hon'ble Court may deem fit in the circumstances of the present case." 4.
Learned Standing Counsel (Criminal) for the State submits that the officers with whom the petitioner apprehends bias on account of professional rivalry are Inspector Sanjay Gupta, Inspector Manjeet Jaglan and Sub Inspector Sundar Gautam. It is further submitted that out of the three officers, two of them i.e., Inspector Manjeet Jaglan and Sub Inspector Sundar Gautam are posted in a different range and are not concerned with the investigation in the present FIR. Inspector Sanjay Gupta, who is posted in the relevant range will not be associated with the investigation which shall be supervised under the supervision of the Additional Commissioner of Police. 5.
In view of the aforesaid, learned counsel appearing on behalf of the petitioner does not press the present petition at this stage and seeks leave to withdraw the same.
