The present petition raises a grievance as regards alleged illegal and unauthorized construction at property measuring 200 sq. yards bearing Plot No.A-65, Amrit Puri, Garhi, Jaggi Gali, New Delhi-110065 with Basement. 2.
Learned counsel for the respondent/MCD strenuously submits that the present petition is not maintainable inasmuch as the petitioner has no locus standi to file the present petition.

Further, it transpires that there are civil proceedings which are ongoing between the petitioner and the respondent nos.4 and 5. 4.

that the property in question has been booked and a work stop notice has also been issued with regard thereto. She submits that further requisite action, in accordance with law, shall be taken against the ongoing or subsisting unauthorized construction at the property in question. Needless to say the same shall be subject to the statutory/appellate remedies of the owner/occupier of the property in question.

In view of the aforesaid statement made by the learned counsel for the respondent/MCD, learned counsel for the petitioner does not wish to press the present petition; the same is accordingly dismissed as withdrawn.
