O R D E R

% 03.02.2020 Vide the present application, the applicant seeks the grant of interim bail for a period of two months submitting to the effect that he is suffering from heart ailments.

On behalf of the DRI, the application is vehemently opposed submitting to the effect that in view of the allegations levelled in the charge sheet against the petitioner there would be an embargo in terms of Section 37 of the NDPS Act, 1985. In view of the submissions that had been made on behalf of the petitioner that the petitioner requires urgent medical treatment, vide proceedings dated 26.08.2019, 30.08.2019, 06.09.2019, 27.09.2019, 09.10.2019, 23.10.2019, 24.10.2019, 30.10.2019, 14.11.2019, 15.11.2019, 11.12.2019, 16.01.2020, the aspect of the requirement of the medical treatment of the petitioner is clearly borne out from the record. The documents as issued by the Synergy Clinic indicating that urgent angiography of the petitioner is required, has been verified by the DRI as per the copy of the email dated 22.01.2020 as submitted on behalf of the respondent as issued to the Senior Standing Counsel for the DRI.

In the circumstances, in the interest of justice, the petitioner is allowed to be released on interim bail for a period of 30 days from the date of his release on filing of his bail bond in the sum of Rs.1,00,000/- with two sureties of the like amount to the satisfaction of the learned Trial Court with directions that he shall surrender on the 30th day of his release, shall not leave the city, shall not make any contact with the witnesses and shall not be involved in the commission of any offence whatsoever.

The application stands disposed of.
