The petitioner has challenged investigation and subsequent proceedings under PMLA, mainly alleging that there is no predicate offence. On being pointed out that synopsis of the petition itself enlists the predicate offences, it is submitted by learned Senior Counsel for petitioner that the offence with which the proceedings commenced is not a Scheduled Offence and the remaining offences could not be added subsequently as predicate offences.

Learned SPP accepts notice and submits that there are a number of concealments in the petition, some of which are pointed out by him. In response, learned Senior Counsel on instructions submits that the necessary disclosures were made in the petition though specific pleading of quashing proceedings were not mentioned due to inadvertence. 4.

Under these circumstances, learned Senior Counsel for petitioner on instructions seeks permission to withdraw this petition with liberty to file afresh.

The petition is dismissed as withdrawn with liberty as sought.
