The present writ petition has been filed seeking the following reliefs: The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Earlier, the petitioner had filed another writ petition being W.P.(C) 4545/2026 with respect to the same property which was disposed of by this Court vide order dated 22nd April, 2026. The operative directions contained in the said order are set out below:

Even the Appellate Court, while dismissing the appeal filed by the petitioner, stated that this would be without prejudice to the rights and contentions of the petitioner and respondent no.2 in the subject property. 11.

Accordingly, the present petition is disposed of while reiterating that the demolition action carried out by MCD would not cause prejudice to the rights and contentions of the parties with regard to the rights, title and interest in the subject property."

After some hearing, Ms. Zubeda Begum, counsel appearing on behalf of the petitioner, seeks to withdraw the present writ petition with liberty to approach the appropriate authorities under the Delhi Rent Control Act, 1958, or to avail of any other remedies available in law, with respect to the rights, title and interest of the petitioner in the subject property. 5.

Accordingly, the writ petition is dismissed as withdrawn with the aforesaid liberty.

The aforesaid observations will not come in the way of the respondent no.1/MCD proceeding to take appropriate action in accordance with the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
