O R D E R

% 04.02.2020 This petition has been filed by the petitioner praying for an order restraining the respondent from allowing another contractor to operate the Kiosk from the same/adjacent side, that is, waiting area of New Emergency Ward of the AIIMS.

The learned counsel for the respondent, on instructions, submits that earlier the Kiosk adjacent to that of the petitioner was allotted in favour of M/s SRS Limited by an allotment letter dated 27.12.2018, however, the same has been cancelled and the said Kiosk is now being run by the AIIMS itself.

In view of the above, the learned counsel for the petitioner seeks leave

to withdraw the present petition with liberty to avail such other remedy, including that of claiming damages against the respondent. The petition is dismissed as withdrawn with liberty as prayed for. Dasti under the signature of the Court Master. NAVIN CHAWLA, J FEBRUARY 04, 2020/Arya
