We are disposing of the appeal by directing that the application of the appellant being IA No. 11730/2016, under Order 39 Rules 1&2 CPC, be listed before the learned Single Judge on 14.02.2017 instead of 27.03.2017. The application of the defendant no.6 under Order 7 Rule 11 CPC being IA No. 12878/2016 be also listed on that date. The learned counsel for the appellant states that the reply to this application shall be filed within two days. The rejoinder affidavit, if necessary, be filed within two days thereafter. The appeal stands disposed of.
