BAIL APPLN. 167/2017 By this application under Section 438 read with Section 482 Cr.P.C., petitioner has prayed for grant of anticipatory bail in FIR No.129/2016 registered at police station Barakhamba Road, New Delhi under Sections 380/403/420/120B/201 IPC read with Section 66 of Information Technology Act, 2000.

Learned Additional Public Prosecutor submits that as of now there is no apprehension of arrest of petitioner since vide order dated 7th January, 2016, trial court has ordered for issuance of five days notice to

petitioner before affecting her arrest.

In view of this statement, learned Senior counsel submits that application is not pressed so far as anticipatory bail is concerned.

He submits that trial court has put certain conditions while passing this order.

One of the condition is that petitioner will not leave Delhi without prior permission of court. It is submitted that this condition be modified only to the extent that petitioner will not leave the National Capital Region so that petitioner may stay in Noida or Gurgaon with her relatives and earn her livelihood. Petitioner has no place in Delhi to stay and she is living in hotel. Accordingly, condition no.(i), as imposed by trial court, shall stand modified to the extent that petitioner shall not leave the National Capital Region without prior permission of the trial court. Petitioner shall however inform the address where she would be living and also provide her mobile number.
