The present Petition is filed under Section 483(1)(b) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the 'BNSS'), seeking modification/relaxation of one of the bail conditions imposed vide order dated 07.10.2024 passed by this Court in connection with FIR No. 293/2024, registered under Sections 307 and 34 of the Indian Penal Code, 1860, (hereinafter referred to as the 'IPC') at Police Station Dwarka North. The bail condition sought to be modified/relaxed reads as under: "vii. Petitioner will mark presence virtually before the concerned I.O. every Thursday of every month between 4 p.m.- 5 p.m."

Learned counsel for the State submits that the date-sheet of the examinations, which is the ground for seeking modification of the bail conditions, has not been filed by the Petitioner. Learned counsel for the Petitioner submits that the examinations of the Petitioner are over and that the Petitioner is also attending the trial. However, due to Condition No. vii of the order dated 07.10.2024, he is unable to mark his presence virtually before the concerned Investigating Officer, as the Investigating Officer has retired and no contact number of any other Investigating Officer has been provided to him. 7.

Learned counsel for the State submits that the Investigating Officer has retired and that they shall provide the mobile number of another police official of the concerned Police Station to the Petitioner, before whom the Petitioner may mark his presence virtually. Let mobile number of another police officer of concerned police station be provided to the Petitioner before whom, the petitioner shall mark his presence virtually. 8.

In light of the aforesaid, nothing further survives for adjudication in the present petition.

Accordingly, the petition stands disposed of. 10.
