The Anticipatory Application under Section 438 of CrPC has been filed on behalf of the petitioner in Fir No. 63/2017 dated 17.04.2017, under Sections 420,406,120B of IPC, registered at Police Station EOW, Mandir Marg, New Delhi.

Vide Order dated 24.06.2019, interim protection was granted to the petitioner. It was observed that the petitioner shall join the investigation till then no coercive steps were directed to be taken against the petitioner. The Charge-Sheet has already been filed but the petitioner has not been named as an accused in the Charge-Sheet. filing a supplementary Charge-Sheet.

In view of the submission made, it is directed that in the event of his arrest, the petitioner shall be released forthwith, with the following conditions:- a) The petitioner shall furnish a personal bond in the sum of Rs.50,000/- with one surety of the like amount to the satisfaction of the Investigating Officer/Arresting Officer/Court. b) The petitioner shall not contact, nor visit, nor offer any inducement, threat or promise to any of the prosecution witnesses or other persons acquainted with the facts of case. The petitioner shall not tamper with evidence nor otherwise indulge in any act or omission that is unlawful or that would prejudice the proceedings in the pending trial.

c) The applicant shall join the investigations as and when directed by the IO.

d) The applicant shall produce all the requisite information, documents in his power and possession, as and when directed by the Investigating Officer.

The Petition is disposed of accordingly. The pending applications also stand disposed of.
