The present petitioner seeks quashing of FIR No.0384/2023 registered at Police Station IGI Airport, Delhi for offences punishable under Section 25 of Arms Act.

Issue notice. Ms. Rupali Bandhopadya, learned ASC accepts notice on behalf of State.

The brief facts of the case are that 23 cartridges in which 19 live cartridges and 4 empty cartridges were found from the luggage of the petitioner, while she was travelling to Bombay along with her father, mother, one sister and one brother on 01.07.2023. It is sifnificant to point out at this juncture that the father of the petitioner namely Shri Hari Nath Singh is having licensed revolver in his name, who is present posted as The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Addl. Commissioner, GST, Meerut, U.P. The father of the petitioner on 06.06.2023 visited the licensing authority for renewal of his Small Fire Arm License where it is mandatory to bring arms and all ammunitions to show before the Authority at the time of renewal. Consequently, the father of the petitioner on that date took his arms and ammunitions in the tolley bag from his Noida house to Meerut, and after renewal he removed the Revolver and kept in safe custody, but inadvertently the ammunition/ bullets left in the trolley bag itself in one part of the bag which was covered with zip. On the date of the journey to Bombay, the family of the petitioner kept their household articles without knowing that bullets are remained in that trolley bag, came to IGI Airport, Delhi on 01.07.

2023 and during scanning of the luggage, it was traced by the security personnel and consequently the FIR was lodged against the petitioner because the luggage was carrying tag in the name of petitioner, though the other luggage were there wherein tags were put in names of other family members. The complaint in this case was registered at the instance of complainant Smt. Reena Ranjan who is present in Court and has been identified by the IO. The petitioner seeks quashing of FIR as well as the proceedings pursuant thereto on the ground that they have settled the matter amicably. The accused present before this Court had tendered unconditional apology and had also given an undertaking that she will not indulge in any such activity in the future. 4.

Learned counsel for the APP for the State on instructions from the Investigating Officer submits that in the abovenoted FIR, the petitioner is the only accused, who has been identified by her counsel and the Investigating Officer and state that father‟s arm license of the accused has been verified. petitioner was travelling together with her father. Inadvertently the cartridges were found in her possession which belong to her father and the accused had tendered her apology. The accused also affirms before this Court that such incident will not take place in future and has also shown remorse. This court is inclined to quash the FIR. 5.

The accused is present in court. Her father‟s arm license is verified. She is a medical student. Both of them were travelling together. Inadvertently the cartridges were found in her possession which belong to her father. It would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing FIR in question.

Consequently, FIR No.0384/2023 registered at Police Station IGI Airport, Delhi for offences punishable under Section 25 Arms Act and the proceedings pursuant thereto are hereby quashed. 7.

Accordingly, the petition is allowed and stands disposed of. 8.
