Present writ petition has been filed with the following prayers. "a. Declare the detention of the Petitioner's brother as illegal and arbitrary, and hence, release the Petitioner's brother;

b. Direct the Respondents to place on record the complete set of latest policies, SOPs or guidelines regarding the "foreigners who claim to be refugees" for the just and proper adjudication of the instant case; and/or c. Pass any other appropriate writ, order or direction which this Hon'ble Court deems fit and proper in the light of the facts and circumstances of the present case and in the interest of justice." 2.

Learned counsel for the Respondent on instructions states that the Petitioner's brother has escaped from the custody of FRRO. He points out that an F.I.R. Foreigners Act, 1946 and Section 188 of the Indian Penal Code, 1860. Photocopy of the said FIR is taken on record. 3.

In view of the aforesaid development, the present writ petition is disposed of as infructuous. In the event the Petitioner's brother is found, the Petitioner shall be at liberty to file a fresh writ petition or seek revival of the present writ petition.
