This petition has been filed seeking anticipatory bail in FIR no. 784/2023 registered at PS Nand Nagri, under Sections 307/506/34 IPC. 2.

This Court had provided the interim protection to the petitioner by order dated 13th May, 2024.

It is stated by counsel for petitioner that they have fully joined and cooperated in the investigation which fact is not refuted by the IO. 4.

However, it is stated that a recovery of the knife which was alleged to be used for stab injury could not be made at the behest of the petitioner. 5.

Counsel for petitioner, however, states that the CCTV footage does not show that the petitioner was carrying a knife. However, he shall fully cooperate in the investigation in order to assist the investigation. 6.

Mohd. Anas had been granted either bail or anticipatory bail by this Court and the Trial Court.

Allegations arose out of a matrimonial dispute and a scuffle ensued between various members of the family.

In light of the above, the Court is of the considered opinion that the petitioner is entitled to anticipatory bail. Consequently, in the event of arrest the petitioner be released on bail on furnishing a personal bond in the sum of Rs. 25, 000/- with one surety of the like amount subject to the satisfaction of the arresting officer/IO/SHO concerned, further subject to the condition that the petitioner will join and cooperate in the investigation as and when directed and not influence any witness/complainant/victim or tamper with evidence of the case.

Accordingly, the petition is disposed of. Pending applications (if any) are disposed of as infructuous.
