The principal controversy involved in the present petition is whether the petitioner is entitled to refund of the stamp duty beyond the period of six months specified under Section 54 of the Indian Stamp Act, 1899. 2.
After some arguments, learned counsel appearing for the petitioner seeks to withdraw the present petition with liberty to file afresh challenging the constitutional vires of Section 54 of the Indian Stamp Act, 1899. 3.
The petition is dismissed as withdrawn with the aforesaid liberty. The pending application is also disposed of.
