In view of the judgment of the Supreme Court in the case of Indian Performing Rights Society Ltd. Vs. Sanjay Dalia and Anr. (2015) 10 SCC 161, learned counsel for the plaintiff very fairly states that the present suit under Order 7 Rule 10 CPC be transferred to the competent court at Mumbai where both the plaintiff and the defendants are located. 2.
Accordingly, the plaint and the original documents are returned to the plaintiff under 7 Rule 10 CPC for being filed before the competent court at Mumbai. Registry will follow the procedure of Order 7 Rule 10 CPC to return the plaint to the plaintiff.
