O R D E R

% 01.03.2017 This is an application under Section 438 Cr.P.C. filed on behalf of the petitioner for grant of anticipatory bail in case FIR No.722/2016, under Sections 323/308/34 IPC registered at Police Station Sarai Rohilla, Delhi. Learned counsel for the petitioner has submitted that the petitioner is an innocent person having no nexus with the FIR bearing No.722/2016, under Sections 323/308/34 IPC, registered at Police Station Sarai Rohilla, Delhi. Counsel for the petitioner has further submitted that the petitioner has already joined the investigation and further ready to join the investigation as and when required to do so and prays that the petitioner may be released on anticipatory bail and the petitioner is ready to abide by any condition which may be imposed on him by this Court. Status report has been filed by the State. Learned APP for the State, on the other hand, vehemently opposes the bail application and submits that the present petitioner is also involved in one more FIR in which he is on bail and there is no merit in the anticipatory bail application and the same is

liable to be rejected. However, the petitioner has joined the investigation. Keeping in view the facts and circumstances, the petitioner is directed to join further investigation as and when required and in the event of his arrest, he be released on bail, on his furnishing bail bond in the sum of Rs.20,000/- with one surety of the like amount, to the satisfaction of the IO/SHO concerned with the condition that the petitioner shall not leave the country without prior permission of the Court below and shall not tamper with the prosecution evidence and shall not visit the house of the complainant or make any communication with the complainant. Application stands disposed of.
