The present petition has been filed under Section 482 Cr.P.C. seeking quashing of FIR No. 527/2017 registered under Sections 498A/34 IPC at P.S. Shakarpur, Delhi on the ground that the parties have amicably settled their disputes.

The present FIR is an outcome of a matrimonial dispute between one Archana/wife (deceased) and petitioner No. 1 (husband) whereas petitioner Nos. 2 and 3 are parents-in-law of the deceased. 3.
Mr. Nawal Kishore Jha, learned APP for the State submits that in the present case petitioners are the only accused persons and respondent No. 2, father of Archana (deceased) is the complainant. He further states that the charge-sheet has been filed in the present case under the aforesaid sections. 4.

02.09.2017 came to be filed at the behest of respondent No.2 after the death of his daughter Archana on 27.07.2017. It is stated that after investigation, the charge-sheet came to be filed under Section 498A/34 IPC and even charges have been framed under the aforesaid sections. It is stated that the parties have settled their disputes on 19.02.2020 before Delhi Mediation Centre, Karkardooma Courts, Delhi. It is further submitted that out of the settlement amount of Rs.2,00,000/-, the balance amount of Rs.1,00,000/- is being paid today through a demand draft bearing number 464792 drawn on Central Bank of India. In terms of the settlement, respondent No.2 is now left with no claim or grievance against the petitioners.

Petitioners and respondent No.2, who are present in Court, have been identified by their counsel as well as by I.O./ SI Kavish Rana and PS Laxmi Nagar, Delhi.

Respondent No. 2 states that he has settled all disputes with the petitioners of his own free will, volition and without any coercion. He also submits that he has no objection in case the FIR is quashed against the petitioners subject to encashment of the demand draft of Rs.1,00,000/- handed over today.

Learned counsel for the petitioners submits that no other proceedings are pending between the parties.

The parties shall remain bound by the statements and undertaking made in Court today.

In view of the above facts and since no useful purpose will be served in continuance of the present criminal proceedings, it is directed that the aforesaid FIR and the consequent proceedings arising therefrom are hereby The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
quashed, subject to encashment of aforesaid demand draft of Rs.1 lac. 10.
With the above directions, the petition is disposed of alongwith miscellaneous applications.
