O R D E R

% 07.02.2017 RP No. 51/2017 (for recall the order dated 30th January 2017)

1. Notice. Mr. M.K. Ghosh, learned counsel accepts notice on behalf of the non-Applicant/Petitioner.

2. Learned counsel for the Applicants/Respondents states that they seek to adduce some more evidence in the arbitration proceedings and, therefore, the time for passing the final award should be extended beyond the period of two months beginning from 31st January 2017. Learned counsel for the Petitioner has also no objection to the extension of time for that purpose. O.M.P. (T) (COMM.) 7/2017

3. Accordingly the time for passing the final award is extended upto 31st May 2017. It is made clear that the above time limit shall be strictly adhered to by both the parties without seeking any unnecessary adjournments.

4. As regards the arbitration being held at Pune, both parties have an objection since they are based in Delhi. Accordingly the next dates of arbitration fixed at Pune shall stand cancelled and the learned Arbitrator will now fix the next hearings at Delhi.

5. The order dated 30th January 2017 is modified to the above extent.

6. The review petition RP 51 of 2017 is disposed of in the above terms.

7. No further orders are called for in OMP(T) (Comm) No. 7 of 2017 and it is also disposed of. The next date, i.e.,10th April 2017 stands cancelled.

8. Order be given dasti.
