% 17.01.2017 In view of the office note, there was a delay to transfer the case file before Learned District & Sessions Judge (South-East) Saket Courts, New Delhi in terms of the order dated 03.10.2016 for 07.11.2016. However, at the time of collecting the case from the registry the concerned court officials has alleged that the documents mentioned at pages 32-49 are not available from part-III of the file due to which they refused to receive the case. On the enquiry in this regard from the Ahlmad in the Court of ADJ-03, PHC stated and given an undertaking on the docket that the missing pages 32-49 has been rearranged and tagged in connected case CS (OS) 158/2007 as per the order dated 27.03.2015 of the Court. Though, there is a delay on the part of the court official to send the case file as per the directions. Therefore, the delinquent are liable to be taken into task.

In view of the facts & circumstances, let the matter be sent to the Ld District & Session Judge, (South-East District) Saket Court. Parties be directed to appear before the Court of Ld District & Session Judge (South-East District), Saket Court on 23.02.2017. The suit files be made available to the Ld District & Session Judge (South-East District) at Saket Court on the date fixed. DR.
