% 09.02.2017 Learned counsel appearing for the petitioner submits that she has taken instructions from the petitioner and the petitioner is willing to settle the matter in case two years' time is granted by the respondent to vacate the tenanted premises. Learned counsel appearing for the respondent has very rightly agreed to the said suggestion of the learned counsel for the petitioner. Let the petitioner place on record within two weeks an affidavit by means of an undertaking of the petitioner/tenant to vacate the tenanted premises as described in the eviction petition i.e.Shop No.9, Bhola Market, Pitampura Village, Delhi, within two years from today i.e. on or before 8.2.2019. In the affidavit the petitioner shall also undertake to pay the agreed rent of Rs.

1,160/- per month by the 7th day of each month, The petitioner shall also undertake to pay arrears of rent, if any. The petitioner shall also undertake to pay all electricity and water charges for the premises in question for the period the property remained in occupation of the petitioner. The petitioner shall also undertake not to induct any third person or cause RC.REV.

any wilful damage to the property.

In view of the above, learned counsel appearing for the petitioner submits that she does not press the present Revision Petition. Learned counsel appearing for the respondent submits that in case the undertaking is filed within two weeks from today and there is no major default in payment of the agreed rentals, the respondent shall not execute the eviction order till 8.2.2019.

Petition stands disposed of. All pending applications, if any, also stand disposed of.
