% 08.02.2016 Present writ petition has been filed challenging rejection letter passed by MCI dated 13th October, 2006 whereby petitioner's application for eligibility certificate under Section 13(4B) of the Indian Medical Council Act, 1956 was rejected on the ground that petitioner was below 17 years. Learned counsel for petitioner states that in W.P.(C) 5055/2010 the same issue was raised wherein the Court directed respondent to issue eligibility certificate.

However, a perusal of the said order reveals that there is no discussion with regard to the plea of underage.

At this stage, learned counsel for petitioner states that petitioner had already filed a writ petition being W.P.(C) 6880/2015, wherein the Court granted liberty vide order dated 21st July, 2015 to withdraw the writ petition and make a representation before the respondent and same was to be decided within six weeks.

However, learned counsel for petitioner states that till date no decision has been taken on the said representation. Learned counsel for petitioner states that eligibility certificate is very crucial for the petitioner as without it neither he can practice medicine nor can apply for higher studies.

Keeping in view the aforesaid, this Court directs the respondent to dispose of petitioner‟s representation dated 21st July, 2015 at page 82 of the paper book within three weeks.

With the aforesaid direction, present writ petition and applications stand disposed of.
