Electrical Works seeking extension of the mandate of the ld. Sole Arbitrator for a period of six months.

The petition pertains to an ongoing arbitration proceeding related to a construction project at Sohawal substation, Uttar Pradesh. As per the petition, the Petitioner, who had been awarded the tender for this project in 2014, faced several delays. Disputes arising between the parties led to arbitration, under the aegis of a ld. Sole Arbitrator appointed under Clause 28 of the SCC. The arbitration proceedings began on 17th October, 2020, and the ld. Sole arbitrator's mandate on 28th February, 2023. Consent from both parties led to a six-month extension, expiring on 31st August, 2023. Further extensions were sought by the Petitioner, leading to the present petition, where the Petitioner has again requested an additional six-month extension to continue with the arbitration proceedings. 6.

Arbitral proceedings are stated to be at the stage of final arguments. Ld. Counsel for the Respondent has no objection to the extension. Accordingly, the mandate of the ld. Sole Arbitrator is extended for a period of six months from 31st May, 2024.

The petition is disposed of.
