This petition has been filed under Section 439(2) read with Section 482 of the Code of Criminal Procedure, 1973 on behalf of the petitioner seeking cancellation of regular bail of the respondent no. 2 in FIR No. 312/2023 dated 08.05.2023 registered for the offences punishable under Sections 420/468/506/120B/34 of the Indian Penal The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Code, 1860 at Police Station Sangam Vihar, granted by the learned Judicial Magistrate First Class-04, South District, Saket Courts, New Delhi vide order dated 07.08.2024 4.

The learned counsel for the petitioner submits that the application seeking cancellation of bail was preferred before the learned Additional Sessions Judge-05, South District, Saket Courts, New Delhi ("ASJ"), which came to be dismissed vide Order dated 25.01.2025. He submits that inadvertently, the grounds that have been raised before this Court could not be taken in the aforesaid application moved before the learned ASJ. At this stage, he seeks permission to withdraw the present application seeking cancellation of bail with liberty to file a fresh application before the learned ASJ, after incorporating the grounds as mentioned in the present application before this Court.

The permission and liberty, as prayed for, is granted. 6.

The petition is, accordingly, dismissed as withdrawn.
