O R D E R

% 22.01.2020 1.What is not in dispute is that the Petitioner is a Group-C employee, and in terms of the judgment of the Supreme Court in State of Punjab v Rafiq Masih (2014) 8 SCC 883 there can be no recovery made from the Group-C and Group-D employees, on any ground whatsoever. 2.In that view of the matter, the action of the Respondents, seeking to deduct a sum of Rs.2,28,000/- from the salary of the Petitioner is hereby held to be illegal. The Respondents are directed to refund to the Petitioner the aforementioned sum recovered from his salary, not later than eight weeks from today, failing which the Respondents will be liable to pay to the Petitioner simple interest @ 6% per annum on the said sum for the period of delay.
