The Petitioner has approached this Court challenging the Minutes of the Meeting of the Inter-Ministerial Committee dated 05.04.2024. 2.
Relevant portion of the said minutes of the meeting reads as under: "3(i). It was seen that various PSIAs have physical presence in more than 100 countries. Committee decided that area of operation should be limited to countries where the firm has a actual physical presence ( not through some agent etc). It was further agreed that if existing PSIAs submit applications for addition of area of operation after opening new branches, same may be decided expeditiously. It was further decided that area of operations for existing PSIAs may also be amended in line with decision of the committee."

It was submitted by the learned Counsel for the Petitioner that the Foreign Trade Policy can be amended only in a manner prescribed under the Policy and the impugned Minutes of the Meeting cannot have the effect of amending the Policy.

Learned Counsel for the Respondents was directed to take instructions as to whether a public notice would be issued or not. 5.
Today, learned Counsel for the Respondent states that at this juncture applications are still being received by the existing PSIAs informing them of their areas of operation and a public notice will be issued immediately thereafter.

In view of the above, this Court of the opinion that the present Writ Petition is premature and accordingly, the same is disposed of with liberty to the Petitioner to challenge the notice as and when the same is issued. 7.
