The present appeal filed under Section 104 read with Order 43 Rule 1 (r) of the Code of Civil Procedure, 1908 (hereinafter referred to as the "CPC") has been preferred against the ad-interim order dated 24.06.2026 passed in an application filed under Order XXXIX Rule 1 & 2 CPC in CS No. 289/2026.

At the outset, learned counsel for the appellant/defendant submits that since the subject application itself is coming up before the Trial Court on 03.07.2026, he seeks leave to withdraw the present appeal, with liberty to raise all contentions before the Trial Court. 3.

The appeal is disposed of with a direction that the Trial Court shall consider the contentions and make an endeavour to dispose of the application as expeditiously as possible.
