The is a petition filed under Section 9 of the Arbitration and Conciliation Act, 1996 seeking the following reliefs against the respondent:
"i. Restrain the Respondent from appropriating or utilizing the amounts payable to the Petitioner under the final bill dated 10/3/2023, pending adjudication of the dispute. ii. Direct the Respondent to deposit an amount of Rs. 4,036,32,222/- (Rupees Four Crore Thirty Six Lakh Thirty-Two Thousand Two hundred twenty Two Only) before this Hon'ble Court or furnish adequate security to safeguard the claim of the Petitioner.
iii. Pass such other and further orders as this Hon'ble Court may deem just and proper in the interest of Justice." 2.

perusal of the same and more particularly paragraph No. 11, shows that the amount in dispute has been admitted by the respondent. The said paragraph is reproduced below:- "11. That in the Budget Estimate (BE) 2025-26, no budget was allotted for this work, and accordingly, no payments could be made. In April 2025, the pending liability for completed works, amounting to approximately Rs 4 crore, was communicated to higher authorities.
Further on 19.05.2025, the Respondent has again communicated to the higher authorities for the budget allocation of the balance amount of Rs. 4.5 crores (approx.), keeping in mind the adding interest to the balance amount, so that the matter can be finally settled. However, the budget allotment is still awaited. Hence, the payment could not be made till date." 3.
Ms. Singh, learned counsel for the respondent states that the respondent is seeking a budget allocation for making the payments to the petitioner. She further states that the respondent is awaiting the said budget allocation and it is because of this reason that the payments have not been made to the petitioner till date.

In light of fact that the amount in dispute has been admitted by the respondent and as the respondent is making efforts to get the budget approval to make the payments to the petitioner, the present petition is disposed of, with direction to the respondent to pay the said admitted amount mentioned in paragraph No. 11 of their reply expeditiously and in any case not later than 6 weeks from today. 5.
In case the amounts are not paid by the respondent within 6 weeks from The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
today, the petitioner will be at liberty to revive the present petition. 6.
