The petitioner has filed the present petition under Section 24 of the Code of Civil Procedure, 1908, inter alia, praying that the petition - OMP (Comm) No. 38/2018 captioned 'M/s Steel Authority of India Ltd. v. M/s Meenakshi Metal Industries (LLP.)' - filed by the petitioner under Section 34 of the Arbitration and Conciliation Act, 1996 impugning an award dated 20.09.2018 be transferred to this Court.

The learned counsel appearing for the petitioner states that the respondent has also filed a petition - registered as OMP (Comm) No. 90/2019 captioned 'M/s Meenakshi Metal Industries (LLP.), Jhansi (U.P.) v. M/s Steel Authority of India Ltd., BSO, Kanpur'- under Section 34 of the Arbitration and Conciliation Act, 1996 impugning the same award, which is pending before this Court.

Since both the petitions impugn the same arbitral award, this Court considers it apposite to allow the present petition. Accordingly, OMP (Comm) No. 38/2019 bearing CNR DLSE010105012018, which is pending before the learned ADJ-03 (South East), Saket Court Complex, is withdrawn from the said Court to be considered by this Court along with OMP (Comm) No. 90/2019 captioned 'M/s Meenakshi Metal Industries (LLP.), Jhansi (U.P.) v. M/s Steel Authority of India Ltd., BSO, Kanpur', which this Court is informed is now listed on 05.08.2019.
