The present petition raises a grievance as regards illegal/unauthorised construction upon the public land by the respondent no.2 outside the property bearing No. T-257, Gali No.2, Quresh Nagar, Idgah Road, Sadar Bazar, Delhi110006. 2.

Learned counsel for the MCD who appears on advance notice submits that the property/construction in question shall be inspected within a period of one week from today and appropriate action with regard thereto shall be taken expeditiously. The said statement is taken on record. 3.

In view thereof, learned counsel for the petitioner does not press the present petition and the same is accordingly dismissed as withdrawn. 4.

Needless to say, in case there is any deficiency in the action taken by the MCD, the petitioner shall be entitled to avail appropriate remedies in accordance with law. Further, any action that may be taken by the MCD shall necessarily be subject to the statutory/ appellate remedies of the owner/ occupier of the property in question.
