% 01.02.2016 Present writ petition has been filed seeking a direction to respondent to consider the request of the petitioner under Section 86 CPC dated 27th October, 2015 within a period of two weeks, as the claims of the petitioner are about to get time barred. Learned counsel for the petitioner states that if a prompt decision is not taken on the application of the petitioner, he shall suffer insurmountable loss as his proceedings for recovery of end service benefits will become time bared.

Issue notice.

Mr.K.K.Jha, Advocate accepts notice on behalf of the respondent.

Keeping in view the limited prayer in the present petition, the same is allowed with a direction to the respondent to decide the petitioner's request dated 27th October, 2015 within a period of four weeks. However, this Court clarifies that it has not expressed any

opinion on the merits of the controversy. The rights and contention of all the parties are left open.

Consequently, the present writ petition is disposed of. Order dasti.
