The present application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (formerly Section 439 of the Code of Criminal procedure, 1973) seeks interim bail for a period of 3 months on medical grounds. The Petitioner is currently undertrial in connection with proceedings arising from FIR No. 172/2023 registered under Sections 21/29/61/85 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at P.S. Special Cell.

Counsel for the Petitioner states that the Applicant is suffering from a spinal ailment and seeks interim bail to get treatment from a private hospital. Reliance is placed on the report of the Office of the Chief Medical Officer, Dispensary Central Jail No. 10, Rohini.

last date of hearing, the Court had called upon the State to verify the medical record of the Applicant. The Court has received the report dated 3rd July, 2025 from the Chief Medical Officer In-Charge, Central Jail, Rohini. As per the said report, the Petitioner is suffering from multiple ailments. He is being provided treatment for the same, however, Chief Medical Officer has stated that despite such treatment, he is still showing symptoms and is facing difficulty in managing his daily life.

In view of the aforesaid report and the fact that the Petitioner intends to take medical opinion and treatment from other hospitals, the Petitioner's request is allowed.

Accordingly, the Petitioner is directed to be released on interim bail for a period of one month on furnishing a bail bond for a sum of INR 25,000/- with one surety of the like amount, subject to the satisfaction of the concerned Trial Court/ Duty MM on the following conditions: (a) The Applicant shall, under no circumstance, leave the NCT of Delhi, without permission of the Trial Court, during the period of his release on interim bail;
(b) The Applicant shall, during the period of his release, provide the address where he would be residing, and shall not change the address without informing the concerned IO/ SHO;
(c) The Applicant shall, upon his release, give his mobile number to the concerned IO/SHO and shall keep his mobile phone switched on at all times; (d) The Applicant shall not commit any offence during the period of his release on interim bail;
(e) The Applicant shall surrender before the concerned Jail Superintendent, on or before the expiry of 1 month from the date of release. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

In the event of there being any FIR/DD entry/complaint lodged against the Applicant, it would be open to the State to seek redressal by filing an application seeking cancellation of bail. 7.
It is clarified that any observations made in the present order are for the purpose of deciding the present bail application and should not influence the outcome of the trial and shall also not be taken as an expression of opinion on the merits of the case.
