O R D E R

The present application is filed seeking pre-arrest bail in FIR No. 291/2025 dated 05.04.2025, registered at Police Station I.G.I. Airport, for offences under Sections 318(4)/336(3)/340(2) of the Bharatiya Nyaya Sanhita, 2023 and Section 12 of the Passports Act, 1967.

It is the case of the prosecution that one person, namely, Gursahib Singh was deported from USA being an illegal entrant. On scrutiny of the travel documents of the said person, it was found that his passport had been tampered with. 3.

Insofar as the applicant is concerned, it was allegedly found during investigation that the applicant had facilitated the travel of Gursahib Singh on the strength of fake visa. travel of Gursahib Singh to USA through a network of agents for a consideration of ₹20 lakhs. It was also found that the applicant had received a sum of ₹7 lakhs in his account from the account belonging to a relative of the accused Gursahib. 4.

On the last date of hearing, this Court had provided interim protection to the applicant, subject to him joining and cooperating with the investigation. Furthermore, as the applicant had volunteered to deposit a sum of ₹7 lakhs to show his bona fides, the said sum was directed to be deposited with the Registrar General of this Court.

The said amount has since been deposited with the Registrar General of this Court. Undisputably, the applicant has also joined investigation on multiple occasions. 6.

The complicity of the applicant in the commission of the alleged offences cannot be ascertained at this stage. 7.

It is also pointed out that co-accused persons have already been admitted on bail.

In view of the above, no purpose would be served by subjecting the applicant to custodial interrogation. 9.

The applicant, in the event of arrest, is directed to be released on bail on furnishing a personal bond for a sum of ₹50,000/- with two sureties of the like amount, subject to the satisfaction of the concerned SHO, on the following conditions: a. The applicant shall join and cooperate with the investigation, if required, as and when directed by the IO; b. The applicant shall not leave the country without the prior permission of the learned Trial Court;

d. The applicant shall provide the address where he would be residing and shall not change the address without informing the concerned IO/SHO;

e. The applicant shall give his mobile number to the concerned IO/SHO and shall keep his mobile phone switched on at all times.

In the event of there being any FIR/ DD entry/ complaint lodged against the applicant, it would be open to the State to seek redressal by filing an application seeking cancellation of bail. 11.

It is clarified that the observations made in the present order are only for the purpose of considering the present application and should not influence the outcome of the trial and also not be taken as an expression of opinion on the merits of the case.

The present bail application is allowed in the aforesaid terms.

The deposited amount is directed to be transferred to the learned Trial Court to be dealt with in accordance with law. AMIT MAHAJAN, J JULY 21, 2025 "SK"
