The present writ petition has been filed under Article 226 of the Constitution of India assailing the applicability of Rule 51 of Schedule-II of the Income Tax Act, 1961 to the proceedings before the Recovery Officer of the Debts Recovery Tribunal established under the Recovery of Debts and Bankruptcy Act, 1993 insofar as the same is violative of substantive rights of third party bona fide purchasers.
