BAIL APPLN. 3307/2021 has been filed by the applicant i.e., Chandra Sekhar Panda, under Section 438 Cr.P.C. read with Section 482 Cr.P.C. seeking anticipatory bail in case ECIR No. 15/DLZO-II/2021/1802, registered by the Enforcement Directorate. BAIL APPLN. 3820/2021 has been filed by the applicant i.e., Simanchala Mishra, under Section 438 Cr.P.C. seeking anticipatory bail in case ECIR No. 15/DLZO-II/2021/2858, under Section 50(2) and 50(3) of Prevention of Money Laundering Act, 2002, registered by Enforcement Directorate.

Learned counsel for the applicants, on instructions, seeks to withdraw the bail applications with liberty to approach the Trial Court, as an objection has been taken by the learned SPP that applicants have directly approached this Court.

Applications stand disposed of as withdrawn with liberty as prayed for, in accordance with law.

Considering that the applicant- Chandra Sekhar Panda in BAIL APPLN. 3307/2021 was granted interim protection on 07.09.2021 and applicant- Simanchala Mishra in BAIL APPLN. 3820/2021 was granted interim protection on 25.10.2021, the same shall continue for a period of 4 weeks from today, to enable the applicants to take recourse to appropriate remedies available in law.

It is made clear that this Court has neither entered into, nor expressed any opinion on the merits of the case and the Trial Court shall decide the applications, as and when filed, on their own merits.
