The present application is filed seeking interim bail for a period of one month in RC-03(S)/2016/SC-III/ND dated 14.06.2016, registered at Police Station CBI SC-III/ND, for offence under Section 302 of the Indian Penal Code, 1860, on the ground that the surgery of the applicant's father is scheduled for 09.05.2025.

The concerned Doctor was examined by the learned Trial Court, who stated that the applicant's father is under treatment and is suffering from 'Lipoma', a benign tumor, located near his spinal cord.

It is stated that there is no other male member in the family of the applicant.

The learned Special Public Prosecutor for the CBI submits that the matter is now listed for final arguments on 13.05.2025 at 02:00 PM and there is every likelihood that the applicant, if released on bail, will abscond.

It cannot be denied that the father of the applicant has to undergo major surgery and the applicant is the only other male member in the family.

In view of the above, purely on humanitarian ground, the applicant is directed to be released on interim bail for a period of four days on his furnishing a personal bond of ₹10,000/- with one local surety of like amount to the satisfaction of the Jail Superintendent and on the following conditions: a. The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case or tamper with the evidence of the case, in any manner whatsoever;
b. The applicant shall provide the address where he would be residing after his release and shall not change the address without informing the concerned Jail Superintendent;
c. The applicant shall, upon his release, give his mobile number to the concerned Jail Superintendent and shall keep his mobile phone switched on at all times;
