After hearing arguments for some time, learned counsel for petitioner, without prejudice to his rights and contentions, does not press the present petition.

He, however, submits that the tenanted premises has already been vacated in terms of the orders passed by the learned Trial Court, albeit, during the execution proceedings and the petitioner herein is also interested in amicably settlement of pending issue with respect to arrears and damages etc. 3.

He also, very fairly, admits that the petitioner herein has neither prayed for any set off nor lodged any counter claim as such. He, however, supplements that there is every likelihood of matter, being settled amicably. 4.

Be that as it may, in view of the above, the present petition is disposed of as not pressed.

appropriate request in this regard before the learned Trial Court and if the other side is also agreeable, the learned Trial Court would see whether the matter can be referred for mediation for finding out amicable solution of the pending disputes between the parties.

The petitioner is also given liberty to move application before the learned trial Court seeking waiver of the cost which was imposed upon him on 05.04.2025.

The pending applications also stand disposed of in aforesaid terms.
