By this application, respondent seeks modification of order dated 18.10.2019. Learned counsel for the respondent contends that the Rent Controller, while disposing of the eviction petition, is likely to be influenced by the observations contained in order dated 18.10.2019.

A application seeking leave to defend the eviction petition is considered by following a summary procedure and any expression of opinion at that stage is only prima facie in nature. It does not in any manner affect the final adjudication of the eviction petition after trial. RC.REV. 68/2016

The application is disposed of clarifying that the Rent Controller would not be influenced by observations contained in order dated 18.10.2019 and shall decide the eviction petition purely based upon its own merits and the evidence led by the parties. 4.
