At the outset, the learned counsel for the respondent draws the attention of the Court to a refund order passed on 4th March, 2017. He further points out that the interest amount corresponding to the refund amount has not been credited to the petitioner's account. He states that this will have to await the decision of the Supreme Court in the appeals filed by the department against the order dated 19th January, 2017 passed by this Court in WP(C) 10701/2016 etc. 2.

In that view of the matter, the interest amount payable to the petitioner on the refund amount, already granted, shall be kept in a separate interest bearing security and will be paid forthwith depending upon the outcome of the appeal filed by the DVAT department before the Supreme Court.

3. The petition is disposed of.
