O R D E R

% 20.02.2024 I.A. 3990/2024 (under Order XXIII Rule 3 read with Section 151 of the Code of Civil Procedure, 1908) and CS(COMM) 489/2023. 1.

At the outset, Mr Kunal Khanna, counsel for the Defendant, states that the cost imposed in terms of order dated 10th January, 2024 has been deposited. He states that he shall furnish proof of such payment to the Registry.

This is a joint application on behalf of the parties under Order XXIII Rule 3 read with Section 151 of the Code of Civil Procedure, 1908 whereby the parties jointly pray for a decree in terms of the settlement enumerated in paragraph no. 2 of the application.

Counsels mentioned in the appearance above, confirm the settlement and pray that the suit be decreed in terms thereof. The aforenoted application is duly supported by affidavits of the Authorized Representatives of the parties.

The Court has perused the terms of the settlement, as recorded in paragraph No. 2 of the instant application, and finds the same to be lawful. 5.

Accordingly, the present suit is decreed in favour of Plaintiffs and against the Defendant, in terms of the settlement mentioned in the application, which shall form part of the decree. Parties shall remain bound by the terms and conditions of the settlement. Furthermore, the terms of the settlement are directed to be executed in a time-bound manner. 6.

Decree sheet be drawn up.

Accordingly, the suit along with pending application(s) stand disposed of.
