% 05.09.2019 Learned counsel appearing for the petitioner has disclosed the fact that the earlier bail application was rejected by the trial Court on the ground that the material witness PW1 is to be examined. However, thereafter the said witness and the material witness had already been examined ( victim and the parents).

Learned counsel appearing for the petitioner further submits that he withdraws the present application with liberty to file before the trial Court by raising all the issues in the present application. Permission is granted. Dismissed as withdrawn with liberty as prayed. I hereby make it clear that the trial Court shall consider the issues raised and the evidence on record, thereafter, pass the order in the application to be filed.
