Learned counsel for the petitioner has invited attention of this Court to the portion of the charge sheet where it has been recorded that during investigations, notices were given to accused persons and they were also HAIL APPLN. 1628/2019 & BAH APPLN. 1630/2019 P-l/2

examined with respect to the allegations and transactions. He has also invited attention of this Court to the concluding paragi'aph of the charge sheet which reads as under:- "The accused persons have not been aiTcsted for the reasons they have joined the investigations as and when they have been noticed. They are local residents of the Delhi/NCR. Detailed inteiTOgation has already been conducted. No evidence regarding pressurizing the witnesses or hampering the investigation have been come on record. Accounts of the accused persons have already been freezed. Moreover the all the offences committed within the radius up to 7 years of imprisonment. Hence notice u/s 41A Cr.P.C. have been given to all the accused persons complying the directions of the Hon'ble Supreme Court laid down in the case title as Arnesh Kumar versus state of Bihar. Charge sheet is prepared and sent for judicial verdict please." 2.

In view of this, learned counsel for the petitioner seeks leave to withdraw the present bail applications with liberty to move an appropriate application before the trial court.

Leave and liberty, as prayed, is granted.

Both the bail applications stand dismissed of as withdrawn. DASTI.
